A divorce is the legal ending of a marriage under the Family Law Act 1975 (Cth), allowing both parties to legally remarry. Australia operates on a no-fault divorce system, meaning the Court does not consider why the marriage ended, only whether it has broken down irretrievably with no reasonable likelihood of reconciliation.
To apply for a divorce in NSW, you must be separated for at least 12 months and one day, and satisfy jurisdiction requirements such as living in Australia, intending to live in Australia indefinitely, or being an Australian resident.
Couples may also be considered separated even if they continue living under the same roof. If the marriage occurred overseas, a valid marriage certificate (and certified translation if required) must be provided to the Court.

Separate legal action may be required, and strict time limits apply for property settlement applications in Australia, generally within 12 months of the divorce becoming final.
